The Police Record Checks Reform Act was passed in December 2015. On November 1, 2018, almost three years later, the Act will finally come into effect.
The Act aims to severely limit police disclosure of non-conviction records. These records include information about unproven allegations, notes from police occurrences, and mental health calls attended by police. The Act will apply to police services in Ontario only and is the first legislation of its kind in Canada.
Prior to this Act coming into effect, this non-conviction information was frequently included on background checks. This had a significant negative impact on the employment, education, volunteer, and travel opportunities for countless Ontarians. When the Act comes into effect, this non-conviction information should no longer be included in background checks provided by Ontario police forces.
