Breaches of Recognizance or Probation

If you have previously been charged with or convicted of a criminal offence, you may be subject to conditions set out in a recognizance or probation order — conditions that can restrict who you may communicate with or where you may go.

These charges are treated seriously because they involve allegations of failing to comply with a court order. For a conviction, the Crown must prove that you did not comply with your terms — but in some circumstances you may have had a lawful excuse to breach your conditions.
