Sexual Assault

For a sexual assault conviction, the Crown must demonstrate voluntary, sexual contact and a lack of consent from the complainant. Consent is evaluated subjectively, based on the complainant’s state of mind at the time of the alleged incident.

Depending on the circumstances and the age of the complainant, the Crown may pursue enhanced sentences and additional conditions — such as listing your name on the National Sex Offender Registry.
